Patrick Distaffen – Status Plea Denied


A convicted child molester who is up for parole next year will remain a level three sex offender, a judge decided Friday.

Patrick Distaffen, 53, pleaded guilty in 1995 to sodomizing an 11-year-old Hilton boy multiple times.

Judge Frank Geraci denied Distaffen’s appeal Friday to lower his sex offender status.

He will remain a level three offender, which is the highest level, until his parole decision in February.

Lloyd L. Stephens Jr. – Repeat Sex Offender rapes teen


A registered sex offender accused of sodomizing a teenage girl and threatening to kill her and her mother faces 15 years in prison after pleading no contest Monday to attempted sexual battery, according to an arrest affidavit released Wednesday.

Lloyd L. Stephens Jr., 40, of the 2100 block of Southeast Shelter Drive, also had been charged with sexual battery with great force, but the charge will be dropped as part of a plea agreement.

Stephens was arrested in February after he allegedly went into the girl’s bedroom and performed sex acts on her. Stephens, who is 6 feet, 4 inches tall and weighs 230 pounds, reportedly returned later and threatened to kill the girl and her mother if she told authorities, according to an arrest affidavit.

The report stated Stephens apologized to the girl before she went to a neighbor’s house and called police. The arrest affidavit indicates Stephens is registered with the state as a sex offender.

Benjamin Curcuru – Baby Raper gets only 45 years


Benjamin Curcuru was found guilty of sodomizing his ex-girlfriend’s two-year-old daughter and was sentenced to 45 years in prison and a $10,000 fine Tuesday.

During the punishment phase of the trial, some described Benjamin Curcuru as an honest family man, while others described him as a dangerous child predator.

After an hour and a half of deliberation, a jury sentenced 30-year-old Curcuru to 45 years behind bars.

During closing arguments, the defense pled with the jury to go easy on Curcuru, given his clean record.

“There is a biblical saying; one cannot have justice without mercy. We are asking for mercy,” Defense Lawyer Mark DiCarlo said.

Before the punishment phase of the trial, jurors heard testimony from those who knew Curcuru best. While family and friends do not excuse what he did, they still say he has a good heart.

“He’s honest, he’s hardworking, he’s kind, he’ll do anything for anybody if you just ask him,” Eric Black, Curcuru’s friend, said.

“He’s good with his family, good with his friends. He has a lot of friendships and he would often help people who were down,” Curcuru’s mother, Laurel Overland, said.

Others believe Curcuru is an absolute danger to the community.

Port Aransas Police Officer Darryl Johnson was asked, “In your opinion based on your training and experience, do you consider Mr. Benjamin Curcuru a dangerous man?”

Johnson replied, “Yes, I do.”

Another person added, “I have never taken care of anyone that had tears like this and I have to say, they had to be incredibly painful when it occurred.”

Curcuru’s ex-girlfriend, Erica Friesenhahn, also took the stand, remorseful for the neglect of her two-year-old daughter. Friesenhahn said she takes full responsibility for her involvement in the child’s injuries.

Charges are expected to be filed against her at a later date.

Even though Curcuru will spend years behind bars, the prosecution said the victim will have to live with the emotional scars for the rest of her life.

“She couldn’t defend herself. There is no telling what horrible unspeakable things this child had to endure that we will never know,” Prosecutor Sandra Eastwood said.

Donald Nitchman – 455 charges of child molestation


A Schuylerville man has been charged with 455 charges of child molestation.

Donald Nitchman, 48, was indicted earlier today on four counts of sexual act in the first degree; 77 counts of criminal sexual act in the second degree; 83 counts of criminal sexual act in the third degree; 144 counts of sexual misconduct — all felonies — sexual abuse in the third degree; three counts of unlawful imprisonment; and 144 counts of endangering the welfare of a child.

The alleged crimes occurred between August 2004 and June 2008.

It’s on a Saratoga County horse farm where investigators said breeder Donald Nitchman was sexually abusing teen boys.

“One of the young boys came forward. He had been sodomized by Mr. Nitchman,” said Saratoga County District Attorney Jim Murphy.

Murphy said with the first boy telling state police, that led investigators to finding two others Nitchman is accused of abusing. Murphy said the incidents started in 2004 when the teens were 13. The indictment is for more than 400 abuse-related charges.

“It is really unprecedented number of counts in the indictment,” said Murphy. “Remember, this is over a four-year period and three separate Nitchman is in Saratoga County Jail and could get life if convicted.

Murphy said each teen is in counseling and will be testifying when Nitchman goes to trial.

“It’s shattering. And no matter what we do with the criminal case, they will never be the same,” Murphy said.

Murphy said Nitchman was originally arrested in June and they are just now indicting him after trying to avoid having the boys testify in front of a grand jury.

Landen E. Garrison III – Repeat Sex Offender gets Life in Prison

Jasper County judge imposed a life sentence Friday on a repeat sex offender for sexually assaulting a boy three years ago, and assessed another defendant seven years in prison for molesting a 10-year-old girl.

Circuit Judge David Mouton sentenced Landen E. Garrison III, 55, to life in prison without parole for first-degree statutory sodomy at a hearing in Jasper County Circuit Court in Joplin. A Jasper County jury had convicted Garrison of the crime at a single-day trial in August.

Garrison, who most recently listed a Joplin address with the court, was living in Kendricktown on April 23, 2005, when he lured a 9-year-old boy from his yard in Carthage with a promise of candy. The boy’s testimony at trial was that Garrison had coaxed him down by the river beneath the railroad trestle north of High Street, where he sexually assaulted him.

Garrison was prosecuted as a persistent offender because of a prior conviction for a sex offense in the 1990s for which he had served time in prison.

He is still facing charges of failure to register as a sex offender and second-degree assault in Jasper County. A probable-cause affidavit alleges that in March he chased a woman in the 1100 block of East Hill Street in Joplin trying to hit her with an ax.
