Timothy Ray Shifflett – Repeat Sex Offender – Takes Alford plea to forcible sodomy


An Albemarle County man will serve 17 years in prison for forcible sodomy and a sex offender registry violation after entering into a plea agreement this afternoon in Albemarle Circuit Court.

Timothy Ray Shifflett, 46, pleaded guilty to violating the sex offender registry by giving false information to the Virginia State Police. He also entered an Alford plea to a count of forcible sodomy, allowing him to maintain his innocence while admitting that the prosecutor had enough evidence to convict him.

Deputy Commonwealth’s Attorney Darby Lowe said in court that Shifflett sodomized a boy who was between 9 and 10 years old between September 2005 and October 2006. Lowe told the judge that the boy’s ill grandmother babysat him during that time. The sexual abuse took place while the grandmother was sleeping, Lowe said in court.

Circuit Judge Cheryl Higgins sentenced Shifflett to 40 years on the sodomy charge, suspending 23 years. He received five years on the registry violation, all of which was suspended. He also will have to be on good behavior for 33 years, two of which will be spent on supervised probation.

Shifflett will not be permitted to have unsupervised contact with minors while on probation.

Brandon Keith Petering – Repeat Sex Offender – Attempts Abduction

A registered sex offender tried to pull a woman into his car on the Victoria College campus Monday morning.

Police arrested Brandon Keith Petering, 25, at a sex-offender class at 10 a.m., about an hour after the abduction attempt, Lt. Jason Cross said.

The Victoria man also grabbed a woman by the waist at the Central Park Apartments just before the college attack, Cross said. Petering did not try to force that woman into his car.

“He went from doing that to going to a sex offender class a few minutes later,” Cross said. The class was in the 3000 block of North Navarro Street.

Early Monday morning, a Victoria College employee noticed a car circling the parking lot and wrote down the license plate number, according to an e-mail College President Tom Butler sent faculty and staff less than an hour after Petering’s arrest.

The school doesn’t have a fast way to alert students about threats, so faculty should read the e-mail to classes, it read.

Clarice Puckett graduated from Victoria College and is pursuing a nursing degree at the University of Houston-Victoria. She had not heard about the attack when she visited the campus bookstore late Monday afternoon.

“I have never felt unsafe here,” she said. Still, she does not come to the campus late at night and is always careful to watch her surroundings, she said.

Being aware of what’s around you is key to safety, Cross said.

Petering pleaded guilty to indecency with a child on Jan. 9. He was accused of exposing himself to a 2-year-old girl in June 2007.

He was sentenced to 10 years probation, although Cross said it’s possible that now will be revoked. Petering served 20 days in jail earlier this year as part of his probation.

Although Petering’s sentence requires him to register as a sex offender, his name did not appear in a Department of Public Safety online search Monday.

Petering is in the Victoria County Jail. He has not yet been formally charged, Cross said.

John Thomas Breeding – Repeat Sex Offender – ‘Biker Santa’


A man known as ‘Biker Santa’ for handing out candy to children from his motorcycle while dressed as Santa Claus faces two felony child sex abuse charges as well as a felony charge of intimidating a witness.

John Thomas Breeding, 62, of Burley in south-central Idaho, has pleaded not guilty to the charges in 5th District Court. He faces trial beginning April 15 on the witness intimidation charge and another trial beginning June 29 on the abuse charges.

For several years Breeding has stopped in busy parking lots on his motorcycle to speak with children and hand out candy canes, while dressed as Santa Claus. The sex abuse charges do not stem from any activity conducted while he was dressed as Santa.

Breeding is accused of soliciting a 9-year-old girl for a sex act at his home between Nov. 15 and 17, according to court records.

The intimidation charge filed Dec. 26 stems from a phone call police say Breeding had with the child’s mother in which police say Breeding said his “biker” friends would harm the woman.

Breeding told the woman to have a newspaper story about the sex abuse charges retracted because he could not be “Biker Santa” anymore, authorities say.

Authorities also say Breeding threatened to have the woman jailed because she failed to protect her daughter from a registered sex offender. Breeding was convicted of rape in 1986, The Times-News reported.

Court records also say that when a police detective questioned him about the alleged intimidation threat, Breeding threatened to hit him with a cane if the detective tried to take him to jail.

Breeding was freed on his own recognizance after posting a $250,000 bond.

Breeding faces up to 25 years in prison if convicted of the sex abuse charges, and up to five years in prison and a $150,000 fine if convicted of the intimidation charge.
