A CONVICTED sex offender who raped a woman in the ladies toilet of a Nenagh fast food restaurant two years ago has been remanded in custody for sentence by Mr Justice Paul Carney.

David Power (27), Brittas, Thurles, Co Tipperary, pleaded guilty at the Central Criminal Court to raping the woman in Supermacs in Nenagh on January 28th, 2007.

Power was previously jailed for terms of five years on October 5th, 2001 and for three years on October 29th, 2002 by Mr Justice Carney for aggravated sexual assaults on women in Cork city in June and September 2000.

Power had been a private in the Army, attached to Collins Barracks in Cork, at the time of his earlier crimes, but had left the Defence Forces when jailed.

The woman told Mr Justice Carney that the rape had affected her as “a woman, girlfriend, daughter, sister, friend, work colleague and human being”. She said her family and community had rallied around to support her.

She said she had been a very social person in the past but found her “sense of safety in the world severely threatened and compromised” after the attack and she kept the Garda number on speed dial while socialising.

Power read from a letter he had prepared for the court and told the victim: “From the bottom of my heart I am so sorry for what I did to you.” He told Mr Justice Carney that he had tried to get access to treatment in custody.

Garda Joan Larkin told the court that the victim was on her way home from a nightclub with her boyfriend when she needed to use a toilet. They stopped at Supermacs and she went upstairs to the ladies toilet while her boyfriend waited outside.

The woman said as she opened the door of a cubicle she was pushed inside by a man who grabbed her by the shoulders and turned her around. She said she struggled but could not get free and shouted to people coming in and out but could not be heard above the loud music in the toilets.

CCTV in the restaurant showed Power going in and out of the ladies toilets. He initially denied remembering anything of the incident but subsequently made admissions.

Jimmy Duprease Craddock – Repeat Sex Offender – Bye Bye Baby Raper


A 46-year-old Wilmington sex offender is on his way back to prison for raping a child under his care.

A New Hanover County Superior Court judge on Tuesday sentenced Jimmy Duprease Craddock to almost 25 years in prison for raping and sexually abusing a girl from the time she was 12 until she turned 16.

In a mostly empty courtroom, he pleaded guilty to 39 counts of statutory rape, first-degree sex offense, first-degree rape of a child and first-degree rape.

“We allowed him to plea so our victim does not have to take the witness stand,” said Assistant District Attorney Connie Jordan.

In the 1980s, Craddock was convicted of second-degree rape, attempted rape and indecent liberties with a child, according to the N.C. Department of Correction. The convictions stemmed from sexual crimes against a relative of the latest victim, Jordan said.

The latest convictions came to light after the victim told one of her siblings, and Craddock was arrested in April 2008.

She eventually told investigators that at least two to three times a week, Craddock “would come into her bedroom and do what he always did,” Jordan said.

A DNA sample from a comforter where Craddock had forced the girl to have sex confirmed he was the perpetrator, Jordan said. Investigators searched Craddock’s house and found pornography on his computer and images of the girl’s friends partially clothed.

In the courtroom, the first victim appeared in court, but did not speak at his sentencing.

In prison, Craddock will be classified as a recidivist, Resident Superior Court Judge Phyllis Gorham said.

Craddock was not on the state’s sex offender list for his first crimes because the law didn’t take effect until the mid 1990s, Jordan said.

That won’t happen again.

Craddock will be monitored with an ankle bracelet when he is released from prison and he will have to register as a sex offender.

Steven Bagley – Internet Pedophile – Charged with child molestation


On a Web site frequented by pedophiles, a young man began bragging last fall about how he’d sexually assaulted a young girl he knew.

The man didn’t divulge his real name or where he lived, the state police said, but as he chatted online off and on for the last several months about the assaults, volunteers working for an Internet watchdog organization, Perverted Justice, searched for his real identity.

A volunteer learned his identity on Thursday and tipped off the Rhode Island State Police, who began looking for him, said Capt. LeRoy V. Rose Jr. The suspect himself divulged his own address on Saturday, Rose said, when someone online offered to send him a package of clothing for the young girl and asked for his mailing address.

The state police allege that Steven Bagley, 19, was the man engaged in the online conversation, and that he gave out his home address at 1327 Elmwood Ave., in Cranston.

Instead of a package, Bagley had state police detectives on his doorstep.

Bagley was arraigned Sunday on a charge of second-degree child molestation and released on $15,000 surety bail. The state police had charged Bagley after interviewing him and after seizing his computer and reviewing his conversations on the site, Rose said. The state police computer forensic detectives are now conducting a thorough investigation of the contents of his computer. The state police have located the child, who is under 14, and are working with the Child Advocacy Center in the investigation, Rose said.

The Perverted Justice organization investigates and exposes pedophiles on the Internet. Its volunteers may pose as children in Web chat rooms or, in this case, they monitor Web sites where pedophiles are talking about children they’re assaulting, or comparing ways to lure children and conceal their assaults, said Xavier Von Erck, the organization’s founder.

“These are the lowest of the low, the most disturbing individuals we run across,” Von Erck said yesterday.

Bagley appeared on one of the Web sites and described his assault on a child, Von Erck said. “He talked about one child and trying to molest other children as well,” Von Erck said. As soon as Perverted Justice obtained the man’s identity, it turned it over to the state police, who acted immediately, he said.

Rose said the state police are investigating whether there are other victims.

Perverted Justice had a hand in exposing an assistant principal at Bishop Hendricken High School in 2004. Timothy J. Sheldon ended up pleading no contest to a charge of soliciting a minor online; the 14-year-old boy he thought he was corresponding with was actually a member of Perverted Justice.

Aaron Jay Lemon – Babysitter used Craigslist to find victim


A 23-year-old Little Canada man convicted of producing child pornography was sentenced Monday in federal court. Aaron Jay Lemon received a sentence of 20 years in prison and supervised release for life, for the production of pornography involving a child he was babysitting in 2007.

According to Lemon’s plea agreement, in August of 2007, he did knowingly employ, use, persuade, induce, entice, and coerce a minor to engage in sexually explicit conduct for the purpose of producing a visual depiction of such contact.

Court documents say that Lemon answered a babysitter ad on Craigslist. He then used a video camera to produce child pornography while acting as a babysitter to the child he was caring for.

The case is part of an effort by the St. Paul Police Department and Project Safe Childhood .

The judge also said Morgan’s risk to offend again is high, as this was his second such conviction. In 1996, he was convicted of felony eavesdropping for using a camera hidden in a duffel bag to take pictures up the skirts of two girls, ages 8 and 12.

A man who amassed more than 18,000 images of child pornography — much of it he created himself over a 20-year span — will spend more than 12 years in prison despite his plea for leniency, a federal judge ruled Tuesday.

Gerald Morgan, 62, pleaded guilty in October to possession of child pornography and being a felon in possession of firearms.

“I know I’m not psychologically normal,” he told U.S. District Judge Robert Cleland in Detroit before the sentence was handed down. “If I was, I wouldn’t be collecting child pornography.

“If I live long enough to get out of prison, I will never do anything illegal again. I’m very sorry if my actions hurt anyone.”

Cleland said Morgan qualifying his apology with “if” was a “red flag flying.”

“I dare say that there were people that were harmed,” Cleland said.

The judge also said Morgan’s risk to offend again is high, as this was his second such conviction. In 1996, he was convicted of felony eavesdropping for using a camera hidden in a duffel bag to take pictures up the skirts of two girls, ages 8 and 12.

In his guilty plea, Morgan admitted that for years, he lured young girls to his Clinton home by saying he was a photographer wanting to take pictures of them. He then secretly filmed the girls changing clothes and using the bathroom.

“Many of them probably still don’t know,” said Eaton Brown, an assistant U.S. attorney.

One of Morgan’s videos included footage of an acquaintance sexually assaulting a 12-year-old girl, officials said. His lawyer, federal defender Richard O’Neill, told the judge that Morgan is particularly remorseful of that incident.

“He has said to me on more than one occasion, ‘I should’ve done something. I don’t know why I didn’t,’ ” O’Neill told the judge.

According to court documents, agents seized 100 videotapes and CDs, six hard drives, numerous photographs, negatives and other materials containing child pornography. Documents allege that more than 18,000 images were found, including video footage from parks, a video of a sexual assault of a 12-year-old girl and sadomasochistic images of children under the age of 12.

Federal prosecutors pushed for a high sentence for Morgan, noting in documents that he used a projector to project images of children onto the wall of his home and videotaped it. “As he records the still images, defendant is heard addressing the young girls in the pictures, calling them by name, and making sexual comments to them,” court documents said.

The sentence includes five years of supervision upon Morgan’s release from prison.

The case emerged as part of Project Safe Childhood, a national initiative launched by the U.S. Department of Justice in 2006 to fight child sexual exploitation and abuse.
