A Stafford County jury last night recommended a 210-year prison sentence for a man who repeatedly molested his 6-year-old niece.

Donald C. Mazariegos-Vicente, 29, was convicted in Stafford Circuit Court of 18 felonies, including rape, forcible sodomy and multiple counts of aggravated sexual battery and taking indecent liberties with a child. The jury-recommended prison term is one of the area’s longest in recent memory. Mazariegos-Vicente will be formally sentenced on March 6 by Judge J. Martin Bass.

Jurors also recommended fines totaling $425,000.

Defense attorney Vanessa Jordan had a tough task yesterday. The victim, now 7, gave clear and detailed testimony about the things her uncle did to her.

In addition, Mazariegos-Vicente gave a statement to police in which he admitted to the molestation after first denying it.

In the statement, Mazariegos-Vicente said the attacks may have happened while he was having a blackout. He also blamed the “Devil” for his actions.

According to the evidence presented by prosecutor Eric Olsen, the child lives in another locality with her mother.

The attacks occurred in 2007 and early this year when the girl came to Stafford to spend time with her father. The girl testified that she was molested more than 10 times in various ways.

At one point she told her father what was happening, but Olsen said the father did nothing more than tell his brother to stop what he was doing.

The father, Cesar R. Mazariegos-Vicente, was convicted of child neglect in August and ordered to spend six months in prison. Olsen said he has or will be deported.

The girl finally told her mother what had happened in February and the mother immediately contacted authorities.

Jordan, who claimed Mazariegos-Vicente was confused when he made his statement to police, asked the jurors to allow her client to be free again one day.

“He can still make a positive turnaround if you give him the opportunity,” Jordan said.

Olsen said Mazariegos-Vicente deserves to spend the rest of his life in prison.

“He has changed this child forever, and he should never have the chance to do it to another child,” Olsen said.

Scott A. Lippert – Another Sex Offender can’t follow rules

A 36-year-old convicted sex offender will spend an additional year in jail after he babysat five children July 2, Manitowoc County Circuit Judge Darryl Deets decided today during the man’s sentencing hearing.

Scott A. Lippert of Mishicot will be on probation for seven and a half years, which is the maximum allowed for the felony sex offender working with children charge. He already has spent six months in jail while waiting for the case to be resolved.

“If you violate this probation, I am going to come down on you like a ton of bricks,” Deets warned Lippert in court.

Lippert is to continue with sex offender treatment, maintain full-time employment, follow all sex offender rules and have no contact with children under age 18 unless supervised by a responsible adult with his probation agent’s approval.

“If I didn’t think you could do it, I wouldn’t put you on probation,” Deets said.

A transfer to the Brown County jail for employment reasons was granted.

Two first-degree sexual assault of a child charges were dropped at an Oct. 8 plea date because the state would be unable to prove the charges without the cooperation of an alleged victim and her mother.

Lippert has followed the terms of his extended supervision after he spent a year in prison for molesting a 12-year-old child in Indiana.

With the exception of the sex offender working with children charge, Lippert has remained out of trouble, Deets said.

Assistant District Attorney Jerilyn Dietz requested Deets to sentence Lippert to two and a half years in prison followed by five years of extended supervision.

“The law is very, very clear” she said. “This violation of the rules … is very, very serious.”

Lippert’s attorney Erik Loy asked for probation and 90 days of jail time at the most.

“(He) is well aware now that (babysitting) is not permitted,” Loy said.

Police said Wednesday that a convicted sex offender was tripped up by a lie detector test when he was asked if he was recently online talking with children. The man was out of jail on probation for obscene contact with a child over the internet.

Mahesh Patel sat next to his wife in a Fayette County court Wednesday. Patel faced his toughest day in court since pleading guilty to obscene internet contact with a child in 2007.

Police said Patel was caught by a lie detector test, when asked if he has recently had internet contact with a child.

When he was arrested in 2006, the Canton dry cleaner was accused of emailing obscene photographs of himself to a girl the thought was 13-years-old. The girl ended up being an undercover police officer.

The 2006 case is a troubling one that police said they remembered well.

“And mixed him with these naked photos were pictures of him with his small children who were 5, 6, 7 at the time,” said Captain Roseanna Dove of the Peachtree City Police Department.

Patel was convicted by a jury in 2006. In 2007 the Georgia Supreme Court overturned Patel’s conviction, citing a misstatement by the trial judge regarding the venue of the case.

Rather than be retried, Patel pleaded guilty and was sent to prison. Patel was out on parole when he failed a lie detector test and admitted to being online with children.

Wednesday, a judge sentenced Patel to 180 days in jail. Patel was banned from owning a computer and accessing the internet and was told he must never again communicate with a child for any reason over the internet.

Chester Sudlow – Repeat Sex Offender Busted by DNA

A man convicted of sexually assaulting a woman in 2007 has been sentenced to 15 more years in prison after investigators used DNA to link him to a similar assault four years earlier.

Chester Sudlow, 55, pleaded guilty to the Oct. 25, 2003, sexual assault as part of an agreement with the Boulder County District Attorney’s Office. He was charged in the case nine months ago, after his DNA was entered into a federal database because of the 2007 conviction.

In the 2003 case, a 20-year-old woman said she got lost after leaving a party on University Hill and asked a man for help near Ninth Street and Aurora Avenue. The man sexually assaulted her and threatened to kill her, Boulder police spokeswoman Sarah Huntley said.

Police took DNA samples during their investigation and entered them into the Combined DNA Index System, but no match was made at the time. Although tips that came in were investigated, no one mentioned Sudlow as a suspect, Huntley said.

Then, on Jan. 27, 2007, Sudlow inappropriately touched a woman whom he followed from the Wild Oats store at 1651 Broadway. He took a plea deal in that case, and was sentenced to 10 years in prison for burglary and attempted sexual assault.

Sudlow submitted a DNA sample when he was transferred to the Department of Corrections.

Clearwater police say they arrested a 37-year-old man when he returned to a car he abandoned when a mother caught him having sex with her teenage daughter.

Roosevelt Young of 2419 44th St. S., St. Petersburg, has been charged with having sex with a minor.

He met with the 17-year-old girl at her home in Clearwater on Thursday to engage in sexual activity, said Clearwater public safety spokeswoman Elizabeth Watts.

Young, a registered sex offender, left in a hurry – without his car — when the girl’s mother came home, Watts said.

Young was being held at Pinellas County Jail. Bail was set at $10,000.

Police say there might be other victims and have requested that anyone with information call investigators at (727) 562-4080.

Christopher Welch – Repeat Sex Offender assaults women in Library


A Level 3 Sex Offender has been convicted of two counts of persistent sexual abuse following the assault of a woman in the Mt. Vernon Public Library.

Westchester County District Attorney Janet DiFiore said that Christopher Welch, 31, of 45 Pleasant St., New Rochelle, was present inside the Mt. Vernon Public Library at South 2nd Avenue on Oct. 16 about 1 p.m. when he accosted a 36-year-old woman by pressing his body into hers and placing his hands against her breasts.

As the victim tried to compose herself following the defendant’s assault, the defendant continued to harass her by raising his hand over his head and towards the back of her head as if to continue the assault.

When another woman came to the victim’s aid, the defendant displayed a cigarette lighter, yelled at the woman to mind her own business and flicked the flame of the cigarette lighter inches from her face.

Welch was then ejected from the library premises.

While loitering outside, the defendant approached a 42-year-old woman, reached around her body and grabbed and squeezed her buttocks.

He then fled the scene.

A description of Welch was broadcast by police and he was found in the vicinity and arrested.

At the time of these assaults, the defendant had previously been convicted of two prior misdemeanor sex offenses within the preceding 10-year period.

Those convictions allowed for the current assaults to be charged as felonies.

Welch will be sentenced on Feb. 3. He faces a maximum of four years in state prison on each of the counts. 12-18-08
