Scumbag Judge Jane Farish whines for the poor pitiful rapist

A visibly upset judge today told a teenager convicted of sexual violation: “If I had my way I would release you today, but I can’t.”

Christchurch District Court Judge Jane Farish spoke of the youth, naivety, and the good family background of Maia Crawford Rongonui who had attacked a young Australian woman tourist in a dark Christchurch street.

“If I had it within my power today I would release you to your family,” the judge said.

But he had inexplicably come to the attention of the authorities at the age of 17, amassing 18 convictions over five months, including the two today.

“They would ensure you would do anything not to come back to court.”

Instead, she jailed the 19-year-old for four years after he was convicted by a jury of assaulting the woman with intent to commit rape, and sexually violating her by unlawful sexual connection.

Rongonui, a shearer from Masterton, was only 17 when he committed the attack.

The judge said she was worried about the effect prison would have on the teenager.

“I have some concerns, as your mother does, about you being corrupted while in jail.”

She hoped the Parole Board would quickly consider his release to the community and his family.

Judge Farish had earlier told crown prosecutor Ruth Thomas that she believed Rongonui needed to “get back to his family and back to a job”.

“Keeping a young man of 19 (in prison) for a lengthy period of time is really only going to ruin him, particularly when he has such good family support.”

Mrs Thomas said she believed Rongonui still did not fully accept what had happened, and the crown believed the attack had been premeditated.

Judge Farish did not accept that. She accepted the victim was vulnerable because she was a visitor to Christchurch, who had lost her way and become separated from her friends.

Rongonui was friendly and offered to show her the way to her backpackers’ hostel.

Instead, he led her down a dark inner city street, Aberdeen Street off Manchester Street.

Judge Farish said she believed Rongonui had been hopeful of a sexual encounter, and something snapped when the woman rebuffed him.

He punched her and kicked her as well as trying to remove her pants. The woman fought back and was able to escape, but semen from Rongonui was found on her clothing.

Mrs Thomas told the court the woman — now a student living on Queensland’s Gold Coast — had significant and ongoing effects from the attack.

Defence counsel Simon Shamy said Rongonui had been an immature 17-year-old at the time of the offence.

Police arrested a Miami man who they claim is connected to three separate sexual assault incidents.

Miami-Dade Police Department said Jasper Lee Tisdale robbed and sexually assaulted three women from September to November. Police said that on Sept. 1, Tisdale broke into a woman’s home while she was sleeping in her bedroom. He placed a knife to the woman’s throat and demanded money. The victim, who does not speak English, did not understand the subject, and began to scream, police said. Tisdale fled the residence on foot.

Tisdale sexually assaulted two other women in October while they were walking in their apartment complex. Tisdale slapped the women before sexually assaulting them, police said.

On Nov. 1, Tisdale broke into another woman’s house and sexually assaulted her at knifepoint while she was sleeping.

Police said they were able to pinpoint Tisdale through investigative leads.

Tisdale admitted to committing the robberies and sexual assaults, police said.

He was charged with armed sexual battery, attempted sexual battery, sexual battery, armed home invasion robbery, armed occupied burglary and battery on the elderly. Tisdale’s criminal history includes several previous arrests in South Carolina for sexual battery, carrying concealed weapons, and multiple assault and battery charges, police said.

Police continue to investigate whether Tisdale may be responsible for other similar incidents.

The public is urged to be aware of their surroundings and to report any suspicious person(s) to the Miami-Dade Police Department at 305-4-POLICE.

It’s been more than three months since repeat child molester John Edward Chrisman was arrested for violating state law by moving into an apartment only a short distance from the Youth Opportunity Center.

Now authorities say their greatest fear about Chrisman’s behavior since his most recent release from prison, in September 2006, has been confirmed — he sexually abused still another child.

The 49-year-old Muncie man was charged this week with child molesting, attempted child molesting and child solicitation, all Class C felonies carrying standard four-year prison terms.

All three charges stem from Chrisman’s alleged interaction with a 13-year-old girl, who lived near his Kilgore Avenue apartment, last June 20.

Chrisman is also charged with illegal sexual offender residency, a Class D felony carrying a standard 18-month sentence.

Chrisman was on probation for a molesting conviction in Randolph County when he was convicted of child molesting in Delaware County in 1998. Both cases involved 5-year-old girls.

Chrisman, then of Union City, was first accused of sexually assaulting the Randolph County child in January 1992.

That charge was dismissed, despite a graphic description from the defendant, after the victim’s mother said she did not want her child subjected to testifying in court. A few months after the charge was dropped, the victim’s mother married Chrisman.

In 1993, Chrisman was charged with molesting the same girl. The 1992 charge was re-filed, and Chrisman pleaded guilty to both charges.

A state law enacted in 2006 forbids those convicted of child molesting, and a handful of other crimes against children, from living within 1,000 feet of facilities frequented by youngsters, including schools and parks.

Chrisman and another convicted molester, 66-year-old James Marion Burnette, were arrested July 18 after authorities determined they were living in an apartment at White’s Mobile Home Park, just west of the Youth Opportunity Center.

If convicted of at least one of the pending felonies, prosecutors will seek to have Chrisman declared a habitual offender, which could add up to 12 years to any prison term he received.

In the 1998 Delaware County case, authorities said Chrisman — who had been released from prison in 1997 — sexually abused a 5-year-old neighbor in his south Muncie apartment.

“This defendant needs to go away. He can manipulate kids and do it again. He needs to go to prison. It’s a most serious offense in our civilized society. I ask he be taken out of society”


It’s the second time a 69-year-old Marcellus man will go behind prison bars. Friday in Cass County Circuit Court, Jerome Wilkins of 54303 Cranberry Road, Marcellus, was sent to prison for second-degree criminal sexual conduct against a young family member.

Cass County Prosecutor Victor Fitz said it was a most serious offense involving a young child and was not the first go around. He said Wilkins was convicted of first degree CSC in 1990 and went to prison for that.

“This defendant needs to go away. He can manipulate kids and do it again. He needs to go to prison. It’s a most serious offense in our civilized society. I ask he be taken out of society,” Fitz said.

Defense attorney James Miller said Wilkins has had many problems which he asked the court to consider. He asked for the low end of the guideline range which was 19 months.

But Circuit Judge Michael Dodge didn’t agree. He said it was Aug. 6 when he victimized the child and it was not the first time. In 1999, he got 5-20 years for first-degree criminal sexual conduct for molesting another family member. He said because of the serious nature of this crime, it dictates the high end of the guideline range which was 38 months. He said he has no mercy and went to the top of the guideline range of 38 months to a maximum of 15 years. Dodge gave him credit for 86 days served and imposed charges of $570.

There is nothing more innocent than a little baby, but detectives say a former Disney employee turned innocent babies into sexual fantasies and traded pornographic pictures of them. Tony Guerra, 21, was sent to federal prison Wednesday for those pictures.

Guerra’s arrest helped unravel an international pornography ring. One very shocking detail that came out in court Wednesday was prosecutors saying Guerra invited an online friend to come to his work at Disney and look for a child to victimize.

While he does not have a record of child abuse, prosecutors say Guerra is extremely dangerous. The former Disney employee will spend the next decade in federal prison. Investigators said he had a sick sexual obsession with babies. On Guerra’s computer they found more than 5,000 pornographic images of small children.

Perhaps the most disturbing, in online chats, prosecutors said, Guerra persuaded a man in Australia to molest his grandchild and post pictures of it on the Internet. They said Guerra then invited another online friend to come visit him at Disney World to look for small kids.

Guerra was arrested last year along with 40 other people who were part of an international online child porn chat room. He pled guilty last spring. Guerra’s attorney argued that his client is developmentally delayed and has severe social problems and that’s the reason he was interested in kids.

“The judge understood that Mr. Guerra has some serious mental and physical problems that contributed to what he was doing and she took that into account,” defense attorney Peter Kenny said.

Prosecutors wanted Guerra to get the maximum 20 years in prison, but the judge sentenced him to 10 years and 10 months behind bars with mental treatment.

Guerra’s mother was in court and cried during much of the proceedings. When he was given the chance to make his statement, Guerra apologized to his family and said he was never doing it again.

When Guerra is released from prison, he will spend the rest of his life on probation and is barred from using the Internet or going to a theme park unless he has the court’s permission.

He turned toward the father of the 4-year-old and said he wasn’t a monster.

“You know me,” Lane said.

NEW PORT RICHEY — Brian Michael Lane was a preschool teacher. Now he’s a sexual predator.

Lane, 30, who worked at Sugar Plum First Class Preschool in Hudson, was arrested in June and accused of fondling a 4-year-old boy and performing a sex act on a 10-year-old boy. On Thursday in court he pleaded guilty to attempted capital sexual battery and two counts of lewd and lascivious molestation. He was sentenced to 20 years in prison.

The hearing was long, strange and contentious.

It was on, off, on again. There was crying, yelling, pointing. The father of the 4-year-old victim got up in court and said Lane was a monster. Lane’s mother got up and said that he wasn’t. For all of it, the 4-year-old was in the courtroom, in the front row, kneeling, watching, wide-eyed.

Lane lived in New Port Richey and used to lead the choir at Bayonet Point Christian Church. He had no prior criminal record and passed all the required background checks when he was hired at Sugar Plum. He fondled the 4-year-old during nap time.

“For less than a minute,” he told Pasco County sheriff’s deputies.

Another allegation came the day he was arrested. That led to the charge involving the 10-year-old from Sugar Plum. Lane was friendly with the boy’s parents.

On Thursday in court, Lane, slump-shouldered and soft-spoken, sat in the inmates’ box wearing glasses, handcuffs and ankle chains. He told Circuit Judge Thane Covert he didn’t want to take the 20-year deal.

This seemed unwise.

Did he want 20 years now or life in prison later? He had confessed to a crime that can come with life in prison. The deal was offered only because the families of the boys wanted the case to be over.

Public defenders Kemba Lewis and Susan Gardner talked to Lane. The quiet but intense conversations went on for a while. Lane finally reconsidered.

The father of the 4-year-old brought the boy because the boy’s counselor thought seeing this would help. The Times is not naming the father to protect the identity of his son.

The father got up to read his statement. He said he was thankful that “our community will at least have one less monster to deal with.”

He also said he was a former corrections officer and suggested that he knew what happened in prison to men who did bad things to small boys.

“I am ashamed to admit,” he said to Lane, “that I find some satisfaction in knowing what you have to look forward to.”

Then it was Lane’s mother’s turn.

Carmella Lane said her son was a good man, and that he was remorseful, and that he had repented. Her voice got louder the longer she spoke. She said that he wasn’t a monster, and that he needed help, and help in his head, she said, not in the form of handcuffs.

“He’s not an animal,” she said.

She turned and pointed at the father of the 4-year-old.

“You might think he is,” she said, “but he’s not a monster.”

Then Lane talked.

He said he was wrong. He said he was sorry. In the end, though, he turned toward the father of the 4-year-old and said he wasn’t a monster.

“You know me,” Lane said.

The man shook his head.

Lane’s voice changed. It got a little more deep and a little less soft. He looked right at the man.

“You do,” Lane said.

“You know me.”
