Marvin Chandler – Repeat Sex Offender Can’t control himself

Marvin Chandler, a former resident of Carlton Manor, was sentenced Monday in Fayette County Common Pleas Court to four years and two months in prison after he pleaded guilty to attempted rape.

On Jan. 28 at Carlton Manor, located at 726 Rawling St., Chandler, a registered sex offender, became agitated, pushed a female staff member to the ground and then touched her inappropriately. “During the time he was doing that, he made comments about wanting to rape her,” said Fayette County Assistant Prosecutor Kristina Rooker.

Other staff members were able to separate Chandler, 37, from the woman. She was not seriously injured.

Chandler was a resident of Carlton Manor because the nursing home specializes in treating patients with behavioral problems, including sex offenders.

Chandler and his attorney, Renae Zabloudil, reached a plea agreement with the prosecution on Monday. He pleaded guilty to the second-degree felony and the other count against him, gross sexual imposition, was dropped by the prosecution.

Judge Steven Beathard sentenced Chandler to two years in prison for the attempted rape conviction plus a sentence enhancement of two years, two months and 14 days. The sentence enhancement is because Chandler violated his post-release control from a prior conviction of gross sexual imposition with a victim under 13 years old.

After Chandler is released from prison, he will be subject to five years of post-release control.

Chandler, formerly a Tier 2 sex offender, is now registered as a Tier 3 sex offender, which is the highest classification. He is required to re-register with the county sheriff every three months for the rest of his life.

Also, Chandler must register any change of residential address, place of employment, or enrollment in a school or institution of higher education.

Chandler originally pleaded not guilty by reason of insanity to the charges against him. He was scheduled to have a competency hearing on Monday until he reached an agreement with the prosecution.

The final psychological evaluation of Chandler concluded that he was competent to stand trial and that he did not meet the criteria of insanity, according to Judge Beathard.
