A man once convicted of gross sexual imposition and abduction faces new sexual assault charges.

Frank M. Cuthbert, 38, of Baltimore, is accused of attacking two young relatives within the past year.

Relatives of the victims, now ages 8 and 13, contacted authorities about the alleged abuse, which occurred when the children were 7 and 12 years old.

Fairfield County Sheriff deputies confiscated several computers, videotapes and compact discs May 2 during a search of Cuthbert’s residence, 6230 McCleery Road, in Baltimore.

They also recovered two .22 caliber weapons inside the home.

The Ohio Bureau of Criminal Identification and Investigation will review the tapes, discs and computers to determine if they contain pornography, Fairfield County Sheriff Phalen said.

Deputies took Cuthbert into custody Monday.

His preliminary hearing is set for May 16.

Cuthbert is charged with one felony count of rape, one felony count of gross sexual imposition and one felony count of having weapons under disability.

Under state law, he is prohibited from possessing firearms because he is a convicted felon.

Cuthbert was in the Fairfield County Jail Tuesday on a $300,000 recognizance bond.

Cuthbert is classified as a Tier II registered sex offender after being convicted of gross sexual imposition and abduction in Franklin County in 1993. As such, he is required to register with the county sheriff’s office every 180 days for 25 years.

He could face up to 20 years in prison if convicted.

James Kennedy – Repeat Sex Offender Caught grooming boy

A SEX offender who groomed a 15-year-old boy with learning difficulties by offering him sweets and shandy has been jailed for 10 months.

James Kennedy, aged 65, from Cunningham Avenue in Runcorn, admitted befriending the disabled teenager, handing him a card with his name and address and giving him gifts including a chocolate selection box.

Placing Kennedy on the sex offender’s register for 10 years at Warrington Crown Court yesterday, Judge Thomas Teague said: “It seems you insidiously cultivated his acquaintance.”

The boy, who cannot be named for legal reasons, met Kennedy at Runcorn Old Town bus stop in September last year.

James Cullen, prosecuting, said Kennedy stuck up for the teen when some boys were picking on him.

Over the next four months Kennedy invited the boy back to his house, offering him a cinema card and alcohol.

Twice he followed the teen into public toilets to watch him urinate and he also put his arm around his shoulder on the bus.

The boy’s mum alerted the police on January 11 after he asked if he could visit his friend Jim’.

Until 2005 Kennedy had only one previous conviction, for indecent exposure in 1979, when he touched a child and performed a sex act in an alleyway.

But he has been a registered sex offender since September 2005, when he admitted three offences against another 15-year-old schoolboy, after he invited him to his house without his parent’s knowledge, touched his legs and attempted to perform a sex act on him through his clothing.

The disabled boy did not visit Kennedy’s home, but Oliver Jarvis, defending, said his client had resisted temptation during the four month period.

Judge Teague said Kennedy’s previous community order had expired in December, and that this offence reached its conclusion in January, so it did not constitute a breach.

He said he did not think Kennedy posed a serious risk of significant harm to the public.

He said: “I think what you had in mind was probably touching this boy over his clothing with your hand.”

Kennedy must now serve a five-year prevention order which includes restrictions on him contacting children under the age of 16, inviting them to his house and accessing certain websites.

Marcos Joel Castro – Repeat Sex Offender Tries to manipulate witnesses

A registered sex offender charged with molesting two Hemet-area teenagers reportedly admitted to investigators he could not control his sexual urges, according to court records.

Marcos Joel Castro, 29, said he would flee to Mexico if the boys’ relatives reported what happened to authorities, according to a request for increased bail signed by Riverside County sheriff’s investigator Greg Harrell.

Castro pleaded not guilty during his arraignment last month.

Riverside County prosecutors charged Castro with 41 counts of sexually abusing the two teenage boys between 2004 and 2008. He faces more than 50 years in prison if convicted, prosecutor Burke Strunsky has said.

Authorities arrested Castro on April 24 in West Hollywood and released him from a Riverside County jail May 1 after he posted $100,000 bail, according to court and sheriff’s records.

Judge John Monterosso increased Castro’s bail to $1 million earlier this week and he was returned to jail May 5, the records show.

Castro, of Monrovia, was convicted in 2002 of oral copulation with a person under the age of 16, according to court records filed in Pasadena.

There is no record of Castro being sent to prison, according to officials with the state’s Department of Corrections and Rehabilitation.

His next court date is set for May 19 at the Southwest Justice Center in French Valley.
