Rally to strengthen Jessica’s Law

Massachusetts must step up and protect the most vulnerable members of society, no more excuses.

Wilmington – Community VOICES is an organization of citizens and parents formed in 2005 with the goal of strengthening laws to protect children and communities from child predators. The group will hold a rally at the Tewksbury Common on Main Street on Sunday, April 13, 11 a.m. to 1 p.m., to support Jessica’s Law, H1688, mandatory minimum sentences for sex crimes against children.

The rally’s focus will be the passage of the Massachusetts version of Jessica’s Law, named after Jessica Lunsford, the 10-year-old Florida girl who was abducted, raped and murdered by a repeat sex offender in Florida in 2005. It has been 185 days since the bill was heard before the Judiciary Committee, and still no action has been taken.

Wilmington resident Christine Woltag said, “As parents united, we have the power to get Jessica’s Law passed. The people of Massachusetts want Jessica’s law, and Rep. O’Flaherty is stalling this bill. We urge him to move this legislation immediately.”

“Never has it been more important for people to mobilize and voice their outrage,” said Victims Rights Attorney Wendy Murphy. “Punishments for sex predators in Massachusetts are shockingly low — judges think nothing of letting the most dangerous offenders roam free to rape children again and again and defense attorneys think it’s OK to file lawsuits against parents who do the right thing by telling someone when a rapist gets a job that gives him access to children. It’s time to take back our streets — our playgrounds — our restaurants — our public libraries and our neighborhoods. Law abiding citizens have rights, too.”

H1688, An Act Relative to the Safety of Children in the Commonwealth was filed in the 2007-2008 Legislative Session and currently has eleven co-sponsors. Some of the provisions in the current bill create mandatory minimum sentences for the following crimes:

· Rape with force — increase the imprisonment sentence to: 10 years to life for the first offense; and 20 years to life for a second and any subsequent offense.

· New penalty for rape with force of a child under 12 — 20 years to life for the first offense; and 30 years to life for the second and any subsequent offense.

· Increase penalty for posing a child in a state of nudity: 10-20 years

· New penalty for posing a child under 14 in a state of nudity: 10-25 years

· Mandatory life sentence with the possibility of parole after 40 years for a second offense of child rape, and a new crime that allows mandatory time for any child rapist who intimidates or coerces a child into not reporting or testifying.

“The time has come that moms come together and let their voices be heard in support of keeping our children safe,” said Debbie Savoia of North Andover, victims’ rights advocate and vice-president of Community VOICES. “Our children have the right to grow up in safe communities and as moms, we will fight for those rights. This rally will show victims that we care and support them and will not be silent anymore. It will also show our legislators that child safety bills must be a priority up on Beacon Hill.”

“It’s time for Massachusetts to join the 42 other states who have passed some version of Jessica’s Law,” said Laurie Myers of Chelmsford, a former rape crisis counselor and president of Community VOICES. “These crimes shouldn’t happen and anyone that makes a choice to commit these reprehensible crimes should be held accountable. Massachusetts must step up and protect the most vulnerable members of society, no more excuses.”

Stevo Forbrick – Sentenced for Child Porn

“It is clear to the court, after listening to you for the last hour and a half, that you do have some psychological problems,” he said. “Those psychological problems may have impaired, to some extent, your ability to understand the wrongful nature of the child pornography you were downloading and watching, but you knew it was illegal, you knew it was wrong and you knew, and admitted today, that hundreds of little children, boys primarily, were victimized.”

What appeared to be a cut-and-dried child pornography case turned into anything but as defendant Stevo Forbrick, 50, told the court his life story before sentencing.

Forbrick had previously entered into a plea agreement and pleaded guilty of attempted sexual exploitation of a minor and attempted exploitation of a minor, class three felonies.

The charges stem from a copious amount of images of nude boys under the age of 15 found in Forbrick’s van. He was stopped heading south out of town after Wal-Mart employees alerted authorities that Forbrick had scanned images of young nude boys at its photo kiosk. Videos found in Forbrick’s van show young boys engaging in various activities while nude, including sexual activities.

Forbrick read a prepared statement to the court that lasted about 1-1/2 hours. He paused to collect himself occasionally, taking a moment to wipe away a tear or clear his throat.

In his statement he said he had been a victim of abuse when he was younger and now is ostracized by his friends, family and religious affiliation.

He claimed that the pictures and videos were not intended for his own sexual gratification, but a celebration of his life as a nudist/peyotist.

He said he had joined The Peyote Way Church in 1983 but had a falling out with church leadership shortly before his arrest. He said he no longer practiced nudism or the partaking of peyote.

Members of The Peyote Way Church believe the cactus buttons, which contain the hallucinogen mescaline, is a spiritual medicine and is their church’s sacrament. Accor-ding to its Web site, the church is located in the remote Aravaipa wilderness.

During his allocution, Forbrick claimed he had seen the error of his ways and prison would only delay the counseling he needs. He said he wanted to leave Graham County and go to a rehabilitation center in Tucson. He said his ultimate goal was to go back to school and earn a nursing degree so he could live in Portland and send his ex-girlfriend’s children to college.

After Forbrick was done speaking, Judge R. Douglas Holt pronounced his sentence.

He reminded Forbrick that he was part of a child pornography ring that had harmed hundreds of young boys.

“You are part of the problem of creating a market for this tremendous evil that has been unleashed through the Internet,” he said.

In sentencing, Holt said he did take into consideration what Forbrick had said and his perceived mental stability.

Holt sentenced Forbrick to 2.5 years in prison with consecutive lifetime sexual offender probation. He also ordered Forbrick to serve a consecutive seven days in jail so he would be sent back to Graham County to register as a sex offender.

“I do not plan on keeping you in jail that long,” Holt said. “I just want to get you here from (the) D.O.C. Otherwise they will let you walk out the door in Santa Rita in Tucson, and you would be homeless, without transportation and no way to get back over here that I know of.”

Holt ordered Forbrick to receive therapy while in prison and then continue the therapy after his release.

Gregory Graham – Child Molesting Cop – BUSTED

“Anytime a child is victimized in that kind of way, it’s a travesty,” Lewis said, “but crooked law enforcement officers, I don’t have much patience for and neither does our department. They’ll be treated just as any other pedophile or criminal. It’s inexcusable.”

A Fulton County police officer has been arrested and charged with child molestation, incest and statutory rape, the Coweta County Sheriff’s Office said.

Gregory Graham, 34, was arrested Friday at his Sharpsburg home, Lt. John Lewis said. Though test results are pending, he was also charged with possession of anabolic steroids. Lewis said that Graham will face more charges upon indictment.

He was scheduled for a Monday afternoon bond hearing.

Graham was charged with three counts of child molestation, two counts of incest and one count of statutory rape. The investigation had been going on for about two weeks, led by Investigator Jason Fetner.

Graham has been placed on unpaid administrative leave, Fulton County police Lt. Darryl Halbert said.

John D. Patrick – Child molester receives 140 years

Madison Superior Court 3 Judge Thomas Newman sentenced a man to 140 years in prison Monday after he pleaded guilty in March to several counts of child molestation.

John D. Patrick pleaded guilty March 17 to three counts of child molesting, all Class A felonies, and two counts of sexual misconduct with a minor, one as a Class B felony and the other as a Class C felony.

The charges had alleged Patrick had molested a girl for several years, beginning when she was 7.
According to a probable cause affidavit filed with the charges:

The girl, who is mildly mentally handicapped, told investigators in August she and Patrick had sex lots of times. Patrick allegedly told the girl that he’d kill her and her mother if she ever talked about the incidents. The girl said the last molestation occurred on Aug. 3.

Patrick admitted to detectives he inappropriately touched the girl and performed sex acts on her several times. He also said he had sex with the girl four or five times.

The girl’s mother told police she walked in one time in June when Patrick and the girl were performing sex acts on one another. She told detectives Patrick had beaten her and her daughter in the past, and she was afraid of him. Patrick also allegedly told the woman that if he went to jail, she’d likely go to jail as well.

The police investigation began when a family friend reported the abuse.
