Superior Court Judge Richard Moses has released another convicted sex offender, who is believed to have since committed more crimes.

In 1989, Stone was convicted of assault and battery after groping a woman. In 1991, he was convicted of assault with intent to rape. He has since re-offended and attacked multiple women in 1991 and 1995.

A judge who released two dangerous sex offenders is being strongly criticized for releasing a third.

Kenneth Stone was released from prison in June after Moses determined he wasn’t sexually dangerous. Stone, a level 3 sex offender, was arrested last weekend for allegedly raping a man in Taunton.

“This particular judge was asked to make a judgment call, and he’s been wrong three times,” said Taunton police Chief Raymond O’Berg.

Stone is the third sex offender released by Moses who allegedly went on to re-offend.

Corey Saunders is accused of raping a young boy in a library earlier this month after he was released by Moses. Moses is also responsible for releasing David Flavell who was arrested last week for peeping at a woman in a bathroom stall at a book store.

“Our experience is these level 3 sex offenders don’t get there because they didn’t do something,” O’Berg said.

The Bristol County District Attorney tried to have all three sex offenders civilly committed. In this most recent case, a court spokeswoman said Judge Moses applied the law and determined the state had not proved that Kenneth Stone was sexually dangerous.

Both police and prosecutors are very concerned about Moses’ decisions in these cases.

Stone is currently being held without bail.

Leandro R. Dearmas – Repeat Sex Offender Pleads for Execution

“I like a woman, I pay,” he said.
“I’m very sorry my behavior is being bad,
but I have a lot of mental problems.”

A Cuban who claims he has mental problems asked Thursday to be executed for raping a Kansas City woman who was six months pregnant.

Instead, he will spend 50 years in prison with no chance of parole.

The sentence issued Thursday by Jackson County Judge Jay Daugherty means that Leandro R. Dearmas, 44, will have to live to nearly 95 before gaining his freedom again.

A jury convicted him in the 2001 rape. Prosecutors charged him after his DNA sample in a felon database matched semen left in the victim. Dearmas claimed the sex was consensual — the same claim he made following a 1983 rape in Wisconsin. He was convicted there, too.

In both cases, he broke into homes, raped the women and stole a window screen as he left. In Wisconsin, he told the victim to meet him for a date later. In Kansas City, he told the woman he would return and leave money in her mailbox.

As a repeat sex offender, he faced a minimum sentence of 30 years without parole.

During the hearing, Dearmas told his interpreter, “Tell them I want the electric chair — that’s what I want.”

His lawyer asked for the minimum. Assistant prosecutor Trisha Lacey asked for life without parole.

After the sentencing, Dearmas asked, “Why are they abusing me?”

He told the judge that he pays $80 or more for sex. “I like a woman, I pay,” he said. “I’m very sorry my behavior is being bad, but I have a lot of mental problems.”

Daugherty listened calmly to those words and more before responding, “Thanks for your comments.”

He said he believes in giving criminals time to vent after he sentences them to 50 years.

The Citrus County Sheriffs Office arrested a Crystal River Middle School math teacher for five counts of possession of child pornography.

Police found multiple files of child pornography on Mark Lachowicz’s computer, e-mail and storage devices.

After police interviewed Lachowicz, the middle school’s resource officer took the teacher into the Citrus County Detention Center. Lachowicz denied ever meeting a child in person or having explicit conversations with minors.

Lachowicz’s bond has been set at $50,000 and has resigned from the Citrus County School District.

Michael D. Donnell – Guilty Possession Child Pornography

A majority of these images depicted prepubescent minors and there are a significant number of images depicting infants and toddlers engaged in sexually explicit conduct. Images depicting sadistic and masochistic conduct were also recovered from Donnell’s computer. The images recovered from Donnell’s computer depict actual, as opposed to computer generated, images of real minors engaged in such conduct.

An Albany man has pleaded guilty to possessing child pornography.

Michael D. Donnell, 42, entered a guilty plea in U.S. District Court Thursday before Judge Norman A. Mordue.

In July 2006, San Francisco Federal Bureau of Investigation (FBI) agents received information about a hardcore child pornography message board entitled “Ranchi”. In October 2006, while using the online identity of a “Ranchi” member, FBI agents posted a hyperlink to an FBI controlled computer in San Jose, Ca. When users clicked on this link, their Internet Protocol (IP) addresses and the date and time they accessed the link were recorded. Several hundred IP addresses were recorded during the 24-hour period the link was active. Donnell’s IP address was one of the addresses identified.

Based upon this information, FBI agents interviewed Donnell on Feb. 20, 2007 and he was arrested on March 22. Donnell admitted that he has many images of child pornography on his computer. Donnell also noted that he obtained said child pornography from Internet sites and utilizing a peer to peer program known as “Bearshare.” Further, he admitted that he has been collecting such images for many years and estimated that he possessed thousands of these images on his computer. Additionally, Donnell noted that he collected such images of both young boys and young girls.

Donnell consented to the seizure of his computer, a homemade computer tower containing three hard drives, including a Western Digital hard drive, which was later submitted for forensic analysis. Said examination revealed that this Western Digital hard drive contained several thousand images of minors engaged in sexually explicit conduct. Said images are in both still and video format. These images depict actual individuals under the age of 18 engaged in, among other things, vaginal intercourse, oral sex, anal sex, masturbation, digital penetration, and the lascivious exhibition of the genitals and pubic area.

A majority of these images depicted prepubescent minors and there are a significant number of images depicting infants and toddlers engaged in sexually explicit conduct. Images depicting sadistic and masochistic conduct were also recovered from Donnell’s computer. The images recovered from Donnell’s computer depict actual, as opposed to computer generated, images of real minors engaged in such conduct.

Donnell knowingly and willfully possessed the aforesaid images located on said computer. In addition, he possessed the images knowing that they depict minors engaged in sexually explicit conduct. He obtained such images from, among other places, websites, message boards, and/or individuals located outside the State of New York.

Moreover, such images, and Donnell’s computer, which was used to obtain and download these depictions, were transported in interstate and foreign commerce and were produced using materials that had been mailed, or shipped or transported in interstate and foreign commerce.

Sentencing will be held July 17 in U.S. District Court in Albany. Donnell faces a maximum penalty of 10 years imprisonment and a fine of $250,000. He was detained pending his sentencing.

Gilbert Chan – Perving on girls at a Cheerleading Competition – Busted for Child Porn

UC Davis police have arrested a writer for the Sacramento Bee on a child pornography possession charge.

Police arrested 52-year-old Gilbert Chan this morning after he agreed to turn himself in to officers.

Chan came to the attention of police back on February 3rd at a cheerleading competition being held on the UC Davis campus.

A witness alerted an officer that Chan was using a videotape recorder in a suspicious manner. During the investigation into that incident, police say they found Chan in possession of child porn.

The investigation into the incident at the cheerleading competition is still under investigation.

Chan was booked into the Yolo County Jail but was later released on $50,000 bail.

Shawn Mofle – Former Coach – hid a video camera

Many in Webster City are mum about what the former coach allegedly did at the middle school. Prosecutors say Mofle hid a video camera in a duffle bag and pointed it at his team while they showered. The indictment reads, “For the purpose of producing visual depictions.”

Prosecutors say the boys did not know their coach allegedly did this on four separate occasions, and yet this dredged up something worse. Investigators found another tape, one that’s five years old.



Police arrested 41-year-old Shawn Mofle of Webster City, after Mofle’s stepson brought police a videotape. It contained images of the seventh grade boys basketball team Mofle coaches, showering in the nude. But the indictment contains even more serious charges.

Many in Webster City are mum about what the former coach allegedly did at the middle school. Prosecutors say Mofle hid a video camera in a duffle bag and pointed it at his team while they showered. The indictment reads, “For the purpose of producing visual depictions.”

Prosecutors say the boys did not know their coach allegedly did this on four separate occasions, and yet this dredged up something worse. Investigators found another tape, one that’s five years old.

Prosecutors say it shows Mofle “Used a person under the age of eighteen to engage in sexually explicit conduct, specifically, intercourse.” The victims are not members of the basketball team.

As teammates and their parents deal with this alleged victimization, the school district released a statement. It asks everyone in town to “Afford them the privacy and confidentiality that might be necessary to do so.”

The federal prosecutor in Sioux City wouldn’t give any information about the alleged victim or victims on the older tape they found. But he did say the investigation is not over because there is more alleged activity.

Mofle is due in court for his arraignment on March 6.
