NASHUA, N.H.—Nashua (New Hampshire)’s mayor is leaving office with a strong statement.

Mayor Bernie Streeter has vetoed an ordinance that would have prevented registered child sex offenders from living within 1,000 feet of schools, parks or day-care centers. It applied to convicted sex offenders whose victims were 13 years old or younger.

Nashua’s board of aldermen passed the ordinance last week.

It had been opposed by the New Hampshire Civil Liberties Union and the New Hampshire Coalition Against Domestic and Sexual Violence.

The board would need at least 10 votes to overturn Streeter’s veto. The ordinance passed by a vote of 7 to 6.

A new mayor and a new board are sworn in Sunday.

William Dawley – Repeat Sex Offender – Rejects Plea Deal


A convicted sex offender accused of sexually assaulting a minor at knifepoint in the Brewster Street rooming house has rejected a deal to serve six to seven years in prison in exchange for his guilty plea.

Instead, William Dawley, 51, is taking his case to trial and according to superior court documents, will be questioning the alleged victim’s credibility.

Scheduled for a three-day trial beginning Feb. 4, Dawley faces two counts of sexual assault and single counts of criminal restraint, kidnapping, criminal threatening and being a felon in possession of a dangerous weapon.

Police allege that on March 12, 2007, Dawley bought the girl two 40-ounce cans of malt liquor and the pair went to his rent-by-the-week room, where he took out an 11-inch knife with a 6-inch blade, held it to her throat and instructed her to disrobe while he made sexual remarks. He is also alleged to have fondled her breasts while holding the knife at her throat and when she resisted, asked, “Who has the knife?”

Through public defender Stephanie Hausman, Dawley petitioned the superior court for the juvenile’s medical, counseling and juvenile court records, arguing that the typically confidential records provide an assessment of her credibility.

In particular, Hausman’s motion for the alleged victim’s DCYF records tell the court the teen twice alleged she was neglected and in both instances DCYF closed the cases as “unfounded.”

As the only direct witness in the case against Dawley, those cases “speak to her credibility,” according to the motion.

Also, that she “suffered consequences” when the neglect claims were dismissed, is relevant “to her motive to fabricate” the assault allegations, argues Dawley’s lawyer. “Any statements made by (the minor) that are inconsistent with her other statements are relevant.”

The alleged victim’s youth services records may also be useful in her client’s defense, wrote Hausman, because she was on “conditional release” of an unspecified nature and drinking alcohol on the date of the alleged assault would have violated the terms of that release. Also, alleges Dawley’s attorney, if she assaulted him with the knife, indicative by a cut to his hand, that too would have violated terms of her release.

Police detective Mike Schwartz testified during Dawley’s arraignment that the girl was able to “get control of the knife” and during a struggle his right hand was sliced.

The prosecution has filed a witness list including ten local police officers, the victim, two state crime lab employees and a series of city residents.

Dawley was convicted in 1983, at Essex County Superior Court in Salem, Mass., of indecent assault and battery and assault with intent to commit rape.

He remains incarcerated at the Rockingham County House of Corrections on $75,000 cash-only bail.

Jeffrey Malley – Boys & Girls Club – Posession Child Porn

A former worker at the Boys & Girls Club in Juneau is accused of possessing child pornography.

Twenty-9-year-old Jeffrey Malley is charged with six counts of possessing child pornography stemming from a police raid on his home in August.

Police say they found hundreds of images and videos of teenagers and children that were stored on a computer hard drive that had been stolen from the club.

Police don’t believe any of the images are of local children.

Malley was fired soon after the raid on his home.

Anthony J. Hirsch teacher’s aide arrested in child porn investigation

A Waunakee teacher’s aide, allegedly caught up in a federal child pornography investigation, has been arrested on suspicion of downloading child pornography from a group of Web sites being monitored by federal investigators.

Police searched the home of Anthony J. Hirsch, 32, and seized a computer, sex toys and other items on Friday, according to a search warrant filed Thursday in Dane County Circuit Court. According to the warrant, the federal Bureau of Immigration and Customs Enforcement contacted Madison police last month to tell them that Hirsch was a “subject of interest” in the investigation of a commercial child exploitation Web site that gave members access to at least 18 child exploitation Web sites.

Hirsch was released from jail on Wednesday. Madison police said Hirsch is an educational assistant for special education students at Waunakee Middle School and formerly worked in a similar job at La Follette High School in Madison. Both school districts have been notified. Hirsch’s job status at Waunakee was not immediately available.

Wayne Zimmerman charged for possession of Child Porn

A federal grand jury has indicted Arkansas City resident Wayne Zimmerman on charges that he possessed child pornography and for “receiving and distributing” child pornography, according to the U.S. Attorney’s Office in Wichita.

According to the indictment, the beginning of the crimes are not known. Zimmerman, however, continued to receive, distribute and possess child pornography through July 17, 2007. The indictment defines child pornography as “visual depictions of minors … engaging in sexually explicit conduct.”

The possession charges hold a possibility of up to 10 years in prison and a fine of $250,000; the receiving and distribution charges allow for five to 20 years in prison and a fine of $250,000 as well.

Steven Richard Benyo & Jeff Nolte Child Porn – Church Camp

A Wheeling man will face a Wood County jury this month to answer several charges related to child pornography that allegedly were committed at a church parsonage.

Steven Richard Benyo Jr., 36, of Route 2, Box 433, Wheeling, is charged with two counts of displaying obscene material to a minor, two counts of use of obscene material with intent to seduce a minor and three counts of sexual assault in the third degree.

Assistant Wood County Prosecutor Sean Francisco said Benyo is a cousin to Jeff Nolte, 41, a former pastor of the Sand Hill United Methodist Church in Williamstown, who is in jail for his involvement in the case.

Francisco said Benyo traveled from Wheeling to Williamstown to assist Nolte with church camp and youth activities. Court documents indicate the offenses occurred during 2001 and 2002 at the church parsonage.

Nolte was sentenced Dec. 21 to three consecutive one-year terms after he pleaded guilty to two counts of contributing to the delinquency and neglect of a minor and one count of battery.

Francisco said one of the contributing counts against Nolte involved serving a minor alcohol and one included showing pornographic material. He said the victim is now married and has a child.

Nolte was indicted on July 26, 2006, during a special grand jury session, but the charges were dismissed because of a technical error. He was re-indicted March 26, when he was charged with three counts each of displaying obscene material to a minor, use of obscene material with intent to seduce a minor, sexual abuse by a custodian and third-degree sexual assault.

In addition to being jailed, Nolte was ordered to register as a sex offender with the West Virginia State Police.

Benyo was indicted in January, but the charges were dismissed on March 7 because of technical error. He was re-indicted March 26.

Timothy Andrew Granberry & William Washington Guilty Child Porn

Two East Texas men pleaded guilty in a Tyler federal court Wednesday to possessing child pornography.

Timothy Andrew Granberry, 47, faces up to 10 years in prison after he admitted to possessing material involving the sexual exploitation of minors on May 23 in Smith County.

Assistant U.S. Attorney Gregg Marchessault said Granberry possessed 736 digital images and three video clips on his personal computer, which he agreed to forfeit to the government. The pornographic images contained minors younger than 12, he said.

Granberry, who is represented by Tonda Curry, was jailed after the hearing in U.S. Magistrate Judge Judith Guthrie’s court.

A 29-year-old man also pleaded guilty to possessing material involving the exploitation of minors.

William Washington admitted to possessing child pornography on his computer in Hopkins County on March 13. He faces up to 10 years in prison.

Marchessault said the defendant possessed between 150 and 300 images that involved minors younger than 12.

Washington was also charged with distributing computer files containing child pornography on Jan. 31 in Gregg County.

Judge Guthrie ordered that the defendant, who is represented by U.S. Public Defender Wayne Dickey, be detained pending his sentencing hearing.

David Harnett Raped 4 year old Child


A Rotterdam paramedic is behind bars, accused of raping and molesting a 4-year-old child.

31-year-old David Harnett of Westcott Road was arrested and charged Tuesday night after police investigated a complaint from Child Protective Services. Harnett was employed as a per-diem paramedic for the Town of Rotterdam, since July of 2006. Before that, he was a full-time civilian paramedic in Rotterdam. Police tell us he will now be fired.

Harnett remains in the Schenectady County Jail without bail.
