Pedophile fears ‘jail justice’

Convicted serial pedophile Paul Delorme’s lawyer says his client faces the “death penalty” if he is sent to a maximum security penitentiary after being declared a dangerous offender yesterday.

“Of course he’s in danger,” said defence lawyer Daniel Brodsky after the decision was handed down in an Ottawa courtroom.

Delorme, who had been serving time in the maximum security ward at Penetanguishene Mental Health Centre, now faces a sentence of an “indeterminate period of time” at a federal maximum security facility.

Delorme pleaded guilty in 2001 to sexually assaulting a seven-year-old girl in a Tim Horton’s bathroom while on a supervised day trip from Brockville Psychiatric Hospital. He was 37 at the time.

Two hospital orderlies, who were responsible for supervising Delorme, were sharing a cigarette in the parking lot as the assault occurred inside.

Brodsky called that a “failure by community staff.”

“(Delorme) needs maximum supervision, not maximum security,” said Brodsky, who expressed fear his client would become an easy target in a penitentiary setting.

“In the pecking order, he’s going to come lower than a slug,”
said Brodsky.

In 1989, Delorme was found not criminally responsible after sexually assaulting a 12-year-old girl in similar circumstances in an Ottawa community centre.

PERSONALITY DISORDER

An insanity plea was accepted in that case. Delorme has been institutionalized since then under supervision of the Ontario Review Board.

Delorme has been in and out of institutions since first being diagnosed with “reactive disorder” at age 4. In a submission to Justice Gerald Morin, Crown prosecutor Curt Flanagan contended Delorme “does not have a mental illness,” but instead has a personality disorder.

Justice Morin was too ill to attend yesterday’s dangerous offender decision, but a statement was read in court.

“(Delorme) overwhelmingly meets the criteria of a dangerous offender,” read Justice Monique Metivier on behalf of Justice Morin.

Among the reasons cited for the decision, Justice Morin said Delorme poses “an extremely high risk to young female children.”

The ORB’s annual reviews have repeatedly concluded Delorme is a threat to society and high risk to reoffend.

Justice Morin’s statement also said Delorme has made “no clinical progress” in his treatments, often refusing counselling and refusing to take drugs to control his sexual impulses.

“I’m extremely sorry for what I did to (the victim) and her family,” said Delorme, dressed in a black jacket with large dark-rimmed glasses and a closely shaven head, feet bound in shackles. “I’m terrified of being sent to the pen and having the key thrown away.”

Brodsky said he plans to appeal the decision.

According to MyFOXTampaBay, John Stelmack, the principal of Scott Lake Elementary School in Lakeland, developed a reputation for being friendly with the students — too friendly, some parents thought.

“He’s very touchy, huggy-feely with the children, as far as hugging them in the morning, saying hello, greeting them,” said parent Stacy Williams. “My initial thought, which a lot of parents thought, was that he was just being overly friendly.”

Parents complained, and the school suspended Stelmack. As part of a subsequent investigation, deputies say, the school seized the principal’s briefcase. Inside were five images of child pornography, which were allegedly created by Stelmack.

According to investigators, Stelmack took photographs of children in normal school settings — one of whom was identified as a 10-year-old student who attended Scott Lake Elementary last year — and digitally superimposed their heads onto nude images.

“The photographs that Stelmack manipulated into child pornography are graphic and repulsive,” Sheriff Grady Judd said. “To think that a school principal, someone who is entrusted with the safety and well-being of hundreds of school children, would do something like this is incomprehensible.”

Stelmack now faces five counts of possession of child pornography, and was jailed on $100,000 bond. He could face more charges after detectives finish a search of his home.

The Polk County Sheriff’s Special Victims Unit arrested John Stelmack, the principal of Scott Lake Elementary School in Lakeland, DOB 2/4/47, this morning, December 21, 2007, at his residence 5749 Deer Track Trail in Lakeland, after investigation revealed he created and possessed child pornography.

Stelmack was suspended from his job as principal by the Polk County School Board on Friday, December 14, 2007, for an administrative investigation. During their administrative investigation they seized a black briefcase from his office, and on Wednesday, December 19, 2007, the school board superintendant contacted PCSO in regards to what they found in that briefcase.

Inside the briefcase were 5 images of child pornography created by Stelmack. Stelmack took routine photographs of children in a school setting — one of whom was positively identified as a 10-year-old student who attended Scott Lake Elementary last year — and digitally superimposed their heads onto nude images. The identified girl’s facial image was on four of the pictures, and another unidentified female child’s face was placed on the body of another nude image. The investigation is ongoing.

Stelmack is married and has 2 adult children. He came to Polk County from the New York state school system. He is being booked into the Polk County Jail today for 5 counts of Possession of Child Pornography, and will have bond set at $100,000. Detectives are serving a search warrant at his home and further charges may be filed against him depending on what is found during the search warrant.

So far during the execution of our search warrant, PCSO deputies have taken a laptop computer and a desktop computer from the home of John Stelmack. So far they have located 100 digital images on the laptop computer, of which possibly 10 to 20 could be classified as child pornography. The same four images that were mentioned earlier, with the face of the 10-year-old former Scott Lake Elementary student, were located on the laptop as well in digital form.

The forensic examination of the computers that PCSO seized is ongoing, and once completed, PCSO detectives will meet with the State Attorney’s Office to determine if and when any further charges will be filed against Stelmack. This meeting with the SAO will occur next week after the Christmas holiday.

There will be no more updates on this case, except for information on whether or not Stelmack posts bond or has a first appearance hearing, until after Christmas.

Johan Mark Doeden – Repeat Sex Offender


MUNCIE — Authorities say a convicted child molester has struck again — in two Eastern Central Indiana counties.

Johan Mark Doeden, 32, most recently of the 700 block of West Queen Avenue in Muncie, has been accused of repeatedly sexually abusing a child in Delaware County between October 2004 and last December.

The crimes occurred when the victim was between 7 and 9 years old, according to court records.

Doeden was charged this month in Delaware Circuit Court 2 with three counts of child molesting, two Class A felonies carrying a standard 30-year prison term and one Class C felony with a standard four-year sentence.

He also is charged with possession of child pornography, a Class D felony with a standard 18-month sentence.

An initial hearing in that case is set for Jan. 3.

In the meantime, Doeden will be held in the Madison County jail in Anderson, where he has been incarcerated since his arrest in August for sex crimes committed in that county.

Doeden this week pleaded guilty to three counts of child molesting — two Class A felonies and one Class C felony — and child solicitation, a Class D felony, in Madison Superior Court 3.

Judge Thomas Newman Jr. set sentencing in that case for Jan. 18.

Doeden was convicted of child molesting in Benton County, in western Indiana, in April 1996 and was sentenced to eight years in prison. He was released from prison in October 1999, according to state Department of Correction records.

Former Mayor John Sommerer – Child Molestation


CORAL SPRINGS – Former Mayor John Sommerer, who ran City Hall for 10 years, was arrested and booked by Coral Springs Police early Wednesday on nine counts of lewd and lascivious molestation, conduct and exhibition on a child in incidents that occurred over a year.

Sommerer served as mayor for 10 years, between 1994-2004.

He is charged with molesting a girl in incidents that occurred between October 1, 2006, and October 31, 2007, an arrest warrant said.

According to an arrest warrant, Sommerer is accused of various acts of inappropriately touching the victim, as well as pressing himself against the victim and asking the child to spray a hose on his exposed body. He is also accused of asking the victim to ride a motorscooter without underwear, the warrant said.

Sommerer tried to make a political comeback in March 2006 after term limits kept him from holding onto the mayoralty two years earlier. He was defeated by Scott J. Brook.

Sommerer, 60, is a certified public accountant and has a master’s degree in business administration from the University of Toronto and a bachelor’s degree from the University of Hartford. He has served as member of the Kiwanis Club, Coral Springs Community Chest, and the Coral Springs Chamber of Commerce.

Sommerer had a reputation in Coral Springs for being a statesman, peacemaker and a dignified leader. He wasn’t a divisive figure in the city, and was well-liked.

One of his pet projects was correcting the city’s ZIP code glitch. He led the charge to try to convince the U.S. Postal Service for years that mail for city residents shouldn’t be addressed to Pompano Beach, saying that the city has lost state revenue sharing funds and insurance premium tax allocations, which are distributed by ZIP code.

During his time in office he also pushed for the American flag to be displayed without showing signs of being tattered or worn-out, saying it was a dishonor to fly the flag in frayed condition and supported art being displayed in public places.

John and Diane Sommerer have lived in their Coral Springs home since 1980 and the couple has four sons. Public records show he has no other arrests.

“It’s disturbing to read the allegations against the individual,” said Coral Springs Police Sgt. Joe McHugh.

“It’s just very sad,” said Vice Mayor Roy Gold. “I hope the family … gets through this.”

Former Vice Mayor Rhonda Calhoun has known Sommerer for 25 years, back when she was an administrative assistant at a Pantry Pride supermarket and he worked in management. They later served together on the City Commission.

She said she couldn’t comment on the criminal allegations.

“I love John,” she said Wednesday. “I’ve known him for a very, very long time and he is a wonderful man.”

“It’s unbelievable,” she said, her voice choking with emotion.

Raymond Barry Cornwall Captured Sex Offender


A sex offender recaptured after allegedly breaching the conditions of his release from jail is back behind bars after being refused bail by a NSW court.

Raymond Barry Cornwall was caught at 8.20am (AEDT) Friday after an off-duty police officer recognised him while jogging on a beach near Wollongong.

Cornwall had been on the run since Wednesday afternoon, when he absconded from his approved Parramatta accommodation 30 minutes after being dropped off.

Earlier that day, he won his release from prison in a successful appeal against a NSW Supreme Court decision to detain him for eight months beyond the expiry of his 14-year sentence.

The NSW Court of Appeal instead imposed a conditional five-year supervision order and approved his release subject to strict conditions, which he is alleged to have immediately breached.

The 52-year-old man made no bail application when he appeared in Wollongong Local Court on Friday afternoon on one count of failing to comply with an extended/interim supervision order.

Bail was formally refused and he was remanded in custody to face Sydney’s Central Local Court on January 15 by audio visual link from prison.

WANTED: Dennis Buck – Registered Sex Offender


Police are hunting for a convicted sex offender found baby-sitting four young children — a sex offender they say showed at least one of the kids dirty pictures and movies.

Dennis Buck, 38, who was previously convicted of molesting his 14-year-old relative in Cuyahoga County, is wanted on two felony counts of disseminating matter harmful to juveniles.

The children’s mother, Sharon Sparks, 32, was arrested Tuesday on three counts of child endangering and a felony county of obstructing official business. She was arraigned Wednesday in Rocky River Municipal Court, and was released on a $7,500 bond.

Westlake police Capt. Guy Turner said the police probe began last month when school officials said Sparks’ children showed up to class in dirty clothes and with poor hygiene.

When officers checked her home, they found Sparks asleep upstairs and a drunken Buck “supervising” the children, ages 2, 6, 8 and 11, Turner said. He was charged with disorderly conduct by intoxication and released several hours later.

Turner said police soon learned that Sparks was Buck’s prison pen pal, and that he’s on probation. His previous convictions include felony burglary, drug possession, gross sexual imposition, abduction, attempted escape and failing to register as a sex offender.

She told police he was “the most caring person she knows,’’ Turner said, and that she was comfortable with him watching her children because she thought he had been framed for the prior sex crime.

“She thought she could mother him, apparently. That strikes me as incredibly naive. She has four children of her own, and she still thinks she can take on the welfare of a sex offender,” Turner said.

Turner said as police investigated Buck’s involvement with the family, they learned that he had shown pornographic movies and magazines to at least one of the children.

On Dec. 5, Children Services took the children from Sparks’ home, and Buck – who was still there – was told he could not be. He was seen at the home after he was given the warning,

but Sparks wouldn’t allow police to search it, Turner said.
